FaradayWire Terms of Service

These Terms of Service (these “Terms”) explain how you can use FaradayWire’s apps, website, and related services (the “Services”) provided by Faraday Foundry LLC(“Faraday Foundry,” “we,” “our,” or “us”). By creating an account or using the Services, you agree to these Terms.

1) Apple iOS License

When you install FaradayWire from the Apple App Store, your license to use the iOS app is governed by Apple’s Standard End User License Agreement (EULA). These Terms apply to your use of our Services generally.

2) Minimum Age

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review these Terms where required by law.

3) Acceptable Use

• Use the Services only for lawful, personal purposes.
• Don’t harass, threaten, or violate others’ rights. No illegal, abusive, or harmful content or activity.
• Don’t bypass security, disrupt the Services, scrape data, or use bots/crawlers without our permission.
• Don’t use the Services to build a competing product or to reverse engineer except as permitted by law.

4) User Content & End‑to‑End Encryption (E2EE)

You may submit messages, media, and other content (“User Content”). You own your User Content. You give us a limited license to store, process, and transmit it only to operate the Services.

Private messages are protected with end‑to‑end encryption. We do not have your decryption keys and cannot read your private message content. Because of E2EE, we typically cannot view or moderate messages; however, we may act on reports using account‑level signals, metadata, abuse patterns, or content you voluntarily share (e.g., screenshots). We may preserve or disclose account information when required by law.

5) YubiKey & Key Management

• No Recovery: We cannot restore lost private keys or decrypt content without your keys.
• Overwriting Keys: Generating a new private key on your YubiKey can erase an existing one; this is irreversible.
• Data Loss: Messages encrypted with an old key will be inaccessible if that key is deleted or replaced.
• Backups: If you need access to older messages, you’re responsible for preserving the relevant keys.

6) Third‑Party Services & Purchases

We rely on third‑party services (e.g., Apple, Google). Their terms apply when you use them. If you purchase through an app store, billing and refunds are handled by that store under its policies.

7) Privacy

Your use of the Services is also governed by our Privacy Policy.

9) Disclaimers & Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE.” We don’t promise they will be uninterrupted, error‑free, or meet your needs. To the fullest extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the greater of: (a) amounts you paid to us in the prior 12 months; or (b) US$100.

10) Changes, Termination, & Contact

We may update the Services and these Terms from time to time. We may suspend or terminate your access if you violate these Terms or create risk. For questions, contact support@faradaywire.com.

Governing law and venue: Georgia, USA. If any part of these Terms is unenforceable, the rest remains in effect.

11) Resolving Disputes & Ending Terms

Resolving disputes. You agree to resolve any claim or dispute with Faraday Foundry LLC arising out of or relating to these Terms or the Services exclusively in the United States District Court for the Northern District of Georgia or the state courts located in Cobb County, Georgia. You also agree to submit to the personal jurisdiction of those courts for litigating such disputes. The laws of the State of Georgia govern these Terms and any disputes between you and Faraday Foundry LLC, without regard to conflict‑of‑law principles.

Ending these Terms. You may end these Terms at any time by deleting FaradayWire from your devices and discontinuing use of the Services. We may modify, suspend, or terminate your access to or use of the Services at any time, including if you violate these Terms or create harm, risk, or possible legal exposure for Faraday Foundry LLC. The following provisions will survive termination: Acceptable Use; User Content & End‑to‑End Encryption (E2EE); YubiKey & Key Management; Disclaimers & Limitation of Liability; Resolving Disputes & Ending Terms; and Contact Us.
